Let’s Paint Tonight terms and Conditions of Use
Thank you for signing up for your Let’s Paint tonight event. By using, visiting, or browsing the letspainttonight.com/letspaint web site, you accept and agree to be bound by these Terms. If you do not agree to these terms, you should not use our services, including our web site.
Definition of terms- EVENT- means the event you have chosen to attend. PAYMENT METHOD– means the method of your payment for the event that you indicated during your registration. YOU/YOUR- shall refer to the person who purchases a ticket(s) for the event, and includes any persons that attend the event utilizing tickets purchased by you. VENUE- shall mean the location where the event will take place. WEBSITE-means the web site hosted by Let’s Paint Tonight: letspainttonight.com and all pages contained therein. TICKETS/TICKETS- means a revocable license sold to you and for which you have paid.
Let’s Paint tonight services
Katie’s Party Entertainment/ Let’s Paint: katiesparty.com/letspaint is an entertainment service that will provide you with painting instruction at a local venue. Katie’s Party Entertainment/ Let’s Paint reserves the right to make changes without notice. Any description of how the service works should not be considered a representation not an obligation with respect to how the service will always work, as Katie’s Party Entertainment/ Let’s Paint at times makes adjustments it’s services and these changes are not completely captured within these Terms.The availability of event venues may change from time to time and could potentially change on the day of the event. The availability of a specific artist/instructor at the event may change at Let’s Paint sole discretion. Events with less than 10 participants may be canceled. Cancellations are very rare and customers will be notified via phone and or email.
End result
Katie’s Party Entertainment/Let’s Paint makes no representations or warranties about the quality of your painting or your experience. Every painting will be unique and truly your own creation.
Start Time
Katie’s Party Entertainment/ Let’s Paint will make every effort to begin/end the instruction at the designated time. However, the time it takes to begin/complete the instruction may will vary and Katie’s Party Entertainment/ Let’s Paint makes no representation as to the exact amount of instruction time at the event.
Materials Provided
Katie’s Party Entertainment/ Let’s Paint will provide all of the equipment needed for the event (paint, canvasses, brushes, easels, and aprons), the quality of these materials may vary and may be affected by a variety of factors.
Capacity Limitations
You may not be able to attend the event due to capacity limitations of the venue. Katie’s Party Entertainment/ Let’s Paint recommends that you purchase your tickets in advance and arrive at the venue at least 30 minutes prior to the start of the event.
Artwork/Paintings Katie’s Party Entertainment/ Let’s Paint reserves the right to change which painting will be painted at the event and may make such change without notice to you.
Unauthorized Use
Katie’s Party Entertainment/ Let’s Paint artwork/paintings are created by Katie’s Party Entertainment/ Let’s Paint. With the exception of your painting at the event, you may not copy or reproduce Let’s Paint artwork/paintings, and you may not sell, lease or distribute any reproduction of any Let’s Paint artwork/painting.
Promotions
Katie’s Party Entertainment/ Let’s Paint promotions may not be combined with any other offers/promotions. You may cancel your evening with Katie’s Party Entertainment/ Let’s Paint at anytime. However, there are no refunds or credits for unused promotional tickets.
Billing
Katie’s Party Entertainment/Let’s Paint will bill the ticket fee to the Payment Method you provide to us during registration. When purchasing a Katie’s Party Entertainment/ Let’s Paint ticket to your event, you are agreeing that Katie’s Party Entertainment/ Let’s Paint is authorized to charge you a ticket fee at the current rate, and any other charges you may incur in connection with your use of the Katie’s Party Entertainment/ Let’s Paint service to the payment method you provided during registration. Please note that prices and charges are subject to change with notice. Billing shall indicate either a charge or debit, as applicable, against your payment method. The purchase price will be billed on the day you purchase the ticket and not on the day of the event. The amount billed for each event may vary for reasons that may include promotional offers. Ticket fees and charges are fully earned upon payment. PAYMENTS ARE NON REFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR UNUSED OR PARTIALLY USED EVENTS. Katie’s Party Entertainment/ Let’s Paint may provide a refund, discount, or other consideration “credits” to some or all of Let’s Paint customers. The amount and form of such credits, and the decision to provide them, are at Katie’s Party Entertainment/ Let’s Paint discretion. The provision of a credits in one instance does not entitle you to credits in the future. Katie’s Party Entertainment/ Let’s Paint may change the fees and charges in effect, or add new fees and charges from time to time, but Let’s Paint will give you advance notice of these changes.
Electronic Transactions
You agree to conduct transactions, including, but not limited to the purchase of your event ticket and the acknowledgement of these terms and future transactions, by electronic means.
Right to terminate
Let’s Paint Tonight reserves the right to terminate or restrict your use of the service, without notice, for any or no reason. Katie’s Party Entertainment/ Let’s Paint does not warrant that any of the events or materials used in connection with the service, nor does Let’s Paint Tonight warrant the operation of the service.
Age Restrictions
Let’s Paint Tonight Service is for adults who are of the legal drinking age 21(or older). Let’s Paint Tonight is not responsible in any manner if persons under the legal drinking age attend the event. In the event Let’s Paint Tonight or its licensee discovers that an attendee is under the legal drinking age, Let’s Paint Tonight or its licensee will refuse to offer instruction/services to any underage individual (even if that individual has a ticket to the event). Let’s Paint Tonight has the right to request that you present a valid form of identification to demonstrate your age, and you agree to comply with such a request. Check event description for age requirements, at some venues children 16 years of age and older may attend.

Venue
At a Let’s Paint Tonight event, you may encounter third-party services “TPS”. These include but are not limited to food and beverage service from the venue where your event will take place. These TPS are provided as a convenience to you, and Let’s Paint Tonight is not responsible for and does not endorse the TPS provided by the venue where your event will take place. You understand that you are responsible for all additional charges you incur at your event, including, but not limited to food and beverage charges. These third-party services are owned or operated by third parties that are not related to, associated with or sponsored by Let’s Paint Tonight . Some of these TPS may even use Let’s Paint/ Katie’s Party Entertainment name in connection with your event. Let’s Paint/ Katie’s Party Entertainment is not responsible for and does not endorse such content. You will need to make your own independent judgment regarding your interaction with these TPS. You agree that the use of any TPS is at your own risk. You further agree to indemnify and hold Katie’s Party Entertainment/ Let’s Paint harmless from all claims involving or relating to the provision of TPS. If you have any questions, concerns, complaints, or claims about a particular TPS, you should contact the support or contact personnel of the particular TPS provider and not Katie’s Party Entertainment/ Let’s Paint, unless otherwise indicated. Disclaimers of Warranties and Limitation of LiabilityKatie’s Party Entertainment/ Let’s Paint services, web site, all content associated therewith, any other features associated with Katie’s Party Entertainment/ Let’s Paint, and your event are provided “as is” and “as available” with all faults and without warranty of any kind. Katie’s Party Entertainment/ Let’s Paint makes no representations or warranties of any kind with respect to the service, web site, and all the content associated with it, or any other features associated with Katie’s Party Entertainment/ Let’s Paint service, and your event. Katie’s Party Entertainment/ Let’s Paint does not guarantee, represent, or warrant that your use of the our service, web site, and all content associated with it, will be uninterrupted or error-free. KATIE’S PARTY ENTERTAINMENT/ LET’S PAINT MAY ELIMINATE OR OTHERWISE MODIFY ANY OR ALL ASPECTS OF THE OUR SERVICE AND YOUR EVENT, WITHOUT COMPENSATION OR NOTICE TO YOU. Katie’s Party Entertainment/ Let’s Paint specifically disclaims liability for the use of TPS, artwork/paintings, and equipment. Without limiting the foregoing, Katie’s Party Entertainment/ Let’s Paint assumes no liability or responsibility for any of the following except in the case of gross negligence or willful misconduct. (i) errors or omissions in the content delivered by Katie’s Party Entertainment/ Let’s Paint service or on the Website or user interfaces; any losses or damages arising as a result of or related to your event, the provision of TPS at your event, the consequences of the provision of TPS at your event, or through the Katie’s Party Entertainment/ Let’s Paint service itself. In no event shall Katie’s Party Entertainment/ Let’s Paint employees, instructors, assistants, and successors or assigns be liable (jointly or severally) to you for personal injury or any special, incidental, indirect or consequential damages of any kind, or any damages resulting from loss, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the use or performance of the Katie’s Party Entertainment/ Let’s Paint, website, TPS, your event, and all content associated therewith, or otherwise related to Katie’s Party Entertainment/ Let’s Paint service, and features or functionality associated therewith. In no circumstance shall Katie’s Party Entertainment/ Let’s Paint ability to you for any damages or losses arising from Katie’s Party Entertainment/ Let’s Paint service, web site, and all content associated therewith, any other features associated with Katie’s Party Entertainment/ Let’s Paint service, and your event exceed the maximum of the ticket price for the event.
You agree to defend, indemnify, and hold Let’s Paint/ Katie’s Party Entertainment harmless with respect to (i) all disputes, claims, actions, or controversies related in any way to the attendance of the event and (ii) all disputes, claims, actions, or controversies related in any way to any event attendees’ attendance of the Event, and that such defense and indemnity shall include all expenses, costs, liabilities, judgments, awards, and attorneys’ fees incurred by Katie’s Party Entertainment/ Let’s Paint Tonight that are related to such circumstances.
Entertainment and Services Content
Katie’s Party Entertainment/ Let’s Paint Tonight provides entertainment and reserves the right to display and promote the filmed or photographed entertainment or other information through the service, including the Website and user interfaces, in any manner Katie’s Party Entertainment/ Let’s Paint Tonight chooses in its sole and absolute discretion.
